CONSUMER RIGHTS – RIGHT OF WITHDRAWAL – CANCELLATION AND RETURN CONDITIONS

RETURN PROCEDURE

After creating a return request, you must package the items you wish to return carefully to ensure they are not damaged during shipment. Include the delivery note sent to you with your order. You can return the products free of charge by bringing them to any Aras Kargo branch with the following details:

Once your returned products arrive, our team will inspect them within 3 business days in accordance with our return policy. If the return does not comply with the return conditions, your return will be rejected, and our customer service will contact you via email. The products will be sent back to you.

If the return meets the return conditions, it will be accepted. The refund for accepted returns will be made to the bank/credit card used during the order. The refund may take up to 7 business days to reflect in your account, depending on the bank.

GENERAL INFORMATION:

By placing an order electronically through the website, you will be deemed to have accepted the preliminary information form and the distance sales contract provided to you.
Consumers are subject to the provisions of the Consumer Protection Law No. 6502 and the Distance Contracts Regulation (RG: 27.11.2014/29188), as well as other applicable laws.
Shipping costs are to be paid by the consumer.
Each purchased product will be delivered to the person or organization specified by the buyer at the address provided, within a period not exceeding 30 days. If the product is not delivered within this period, the buyer may terminate the contract.
The purchased product must be delivered complete, in the specified condition, and with any warranty certificates, manuals, or other documents, if applicable.
If the purchased product becomes impossible to sell, the seller must notify the buyer in writing within 3 days of learning about the situation. The full price must be refunded to the buyer within 14 days.

IF THE PURCHASED PRODUCT IS NOT PAID:

If the buyer does not pay for the product or cancels the payment via bank records, the seller’s obligation to deliver the product ends.

UNAUTHORIZED USE OF CREDIT CARDS FOR PURCHASES:

If it is determined that the payment was made with a credit card by unauthorized persons after the product is delivered, and if the product payment is not received by the seller from the relevant bank or financial institution, the buyer must return the product within 3 days, with the shipping cost borne by the seller.

IF THE PRODUCT CANNOT BE DELIVERED WITHIN THE STIPULATED TIME DUE TO UNFORSEEABLE REASONS:

If there are force majeure circumstances that the seller cannot foresee, and the product cannot be delivered on time, the buyer will be informed. The buyer can request the cancellation of the order, replacement with a similar product, or postponement of the delivery until the obstacle is removed. If the buyer cancels the order and has paid in cash, the refund will be made within 14 days. If the buyer paid by credit card, the refund will be made to the bank, but it may take 2-3 weeks to reflect in the buyer's account.

BUYER'S OBLIGATION TO CHECK THE PRODUCT:

Before accepting the product, the buyer must inspect it for any damages such as dents, breaks, torn packaging, etc. Damaged or defective products should not be accepted from the courier. If the product is accepted, it is assumed to be undamaged. The buyer must take care of the product after delivery. If the right of withdrawal is to be exercised, the product must not be used. The invoice should also be returned along with the product.

RIGHT OF WITHDRAWAL:

The buyer can exercise the right of withdrawal within 14 days from the delivery date of the product to them or the person/organization at the address they provided, without any legal or penal liability and without providing any reason, by notifying the seller through the contact information provided below.

RIGHT OF WITHDRAWAL PERIOD:

If the product purchased is a service, the 14-day period begins from the date the contract was signed. In service contracts where the consumer’s approval has been given to start the service before the withdrawal period ends, the right of withdrawal cannot be exercised.

Costs arising from the exercise of the right of withdrawal are borne by the seller.

To exercise the right of withdrawal, the buyer must notify the seller in writing by registered mail, fax, or email within 14 days, and the product must not have been used according to the provisions of the “Non-returnable Products” section of this contract.

EXERCISE OF THE RIGHT OF WITHDRAWAL:

The invoice of the product delivered to the buyer or third party (if the product is a corporate order, the return invoice issued by the company must be included).
Return form, packaging, and any accessories of the products should be delivered in full and undamaged.

RETURN CONDITIONS:

The seller is obliged to return the total amount and any documents obligating the buyer to pay within 10 days from the receipt of the withdrawal notification, and to take the product back within 20 days.

If the product’s value decreases due to the buyer’s fault or if the return becomes impossible, the buyer must compensate the seller’s losses in proportion to their fault. However, the buyer is not responsible for changes and damages arising from proper use within the withdrawal period.

If the buyer’s return causes the campaign discount to be below the required limit, the discount will be canceled.

PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED:

Products made according to the buyer’s specifications or clearly personal needs that cannot be returned, such as lingerie, swimsuits, makeup products, disposable items, perishable goods, or products with an expiration date, cannot be returned after the packaging is opened. Products that mix with others and cannot be separated by nature, such as subscription services, periodicals like newspapers and magazines, digital content, software, data storage devices, office supplies, and others as specified in the regulations cannot be returned.

Cosmetics and personal care products, lingerie, swimwear, books, software, DVDs, CDs, and stationery (e.g., toner, cartridges) can only be returned if unopened, unused, and undamaged.

DEFAULT AND LEGAL CONSEQUENCES:

If the buyer defaults on payments made with a credit card, they acknowledge and agree that they will be liable to the bank under the credit card agreement and that the bank may pursue legal action and demand costs and attorney fees. The buyer also agrees to pay the seller for any damages resulting from the delayed performance of the obligation.

Credit card payments can be made online through our website, with the option for single or installment payments. For online payments, the payment will be deducted from your credit card upon completing the order.
