MEMBERSHIP AGREEMENT

BİSTEX Tekstil A.Ş. operating the website www.jiber.com.tr, located at Dökmetaş Mah. Tekstil İht. OSB-1 CAD. NO:2 İç Kapı No:1 Yenişehir/DİYARBAKIR, Turkey.
The User who is a member of the website www.jiber.com.tr ("Member").

1. SUBJECT

The subject of this Agreement is to define the general usage terms, rules, and legal responsibilities of the parties regarding the website www.jiberstore.com.tr owned by JİBER.

2. RIGHTS AND OBLIGATIONS OF THE PARTIES

2.1 Security of Information: The Member is fully responsible for the security, storage, and use of their username and password. JİBER is not responsible for any direct or indirect damages caused by negligence or mistakes regarding the Member's username and password security.

2.2 Accuracy of Information: The Member guarantees that the information provided (e.g., name, surname, phone number, email, etc.) is accurate, complete, and in compliance with the law. The Member agrees to update their information if there are any changes and acknowledges that JİBER is not responsible for any consequences of failing to do so.

2.3 Compliance with Laws and Rules: The Member agrees to act in accordance with the terms of this Agreement, the rules set by JİBER, and applicable laws when using the website.

2.4 Notification: The Member consents to being contacted via various means such as email, SMS, and phone for promotional and informational purposes, unless they opt out through the "My Account" section of the website.

2.5 Use of Personal Data: The Member agrees that their personal data will be processed and used in accordance with the Privacy Policy and the Information Disclosure Text. This data may be used for statistical evaluations, marketing, and improving the services offered by JİBER.

2.6 Personal Data Processing: The Member gives consent to the processing, transfer, and storage of their personal data in accordance with the Law on Protection of Personal Data No. 6698.

2.7 Data Security: JİBER takes necessary measures to ensure the confidentiality of personal data. However, it does not guarantee 100% security, and personal data may be exposed due to unforeseen circumstances.

2.8 Security of Username and Password: JİBER is not responsible for any damages caused by the Member’s negligence regarding the security of their username and password.

2.9 Prohibited Activities: The Member cannot engage in activities that disrupt the general operation of the website or hinder the use of the website by other users.

2.10 Responsibility for Website Use: The Member is solely responsible for any legal or criminal consequences of their actions on the website and agrees not to hold JİBER liable for any damages arising from their use.

2.11 Website Management: JİBER reserves the right to modify, suspend, or terminate the website's operation at its discretion.

2.12 Applicability of the Agreement: This Agreement applies to all platforms, including mobile platforms, where JİBER operates.

2.13 Privacy Policy: The Member agrees to comply with the Privacy Policy in effect for the website.

3. INTELLECTUAL PROPERTY RIGHTS

The Member acknowledges that all content, including design, text, images, and code, on the JİBER website is owned by JİBER and cannot be used without written permission.

4. ANTI-BRIBERY AND ANTI-CORRUPTION

The Member agrees to comply with all anti-bribery and anti-corruption laws and regulations, and will not engage in any activities that may constitute a violation of such laws during the term of this Agreement.

5. FORCE MAJEURE

JİBER is not responsible for any delay or failure to perform its obligations due to force majeure events such as natural disasters, pandemics, wars, etc.

6. ASSIGNMENT

The Member may not transfer their rights and obligations under this Agreement to any third party. JİBER, however, may transfer its rights and claims to other companies within the JİBER group without the Member’s prior consent.

7. ENTRY INTO FORCE

This Agreement will be effective as soon as the Member completes the registration process and accepts the terms. JİBER reserves the right to cancel the membership and terminate the Agreement if the Member violates any terms.

8. AMENDMENTS

All changes to this Agreement are at JİBER’s discretion and will be announced on the website. Members are deemed to have accepted these changes by continuing to use the website.

9. INTERPRETATION OF HEADINGS

Headings in the Agreement are for convenience only and will not affect the interpretation of the Agreement.

10. JURISDICTION

The Member may submit complaints and objections to the consumer arbitration committees or consumer courts in the district where they purchased the product or reside, within the monetary limits determined annually by the Ministry of Customs and Trade.
